NO PURCHASE IS NECESSARY TO ENTER OR WIN.
The Sprout Summer Fun Fridays Contest (“Contest”) starts on June 9, 2008 at 12:01
AM Eastern Time (“ET”) and ends on August 25, 2008 at 5:00 PM ET (“Contest Period”).
The Contest will be divided into eleven (11) weekly entry periods (each, an “Entry
Period”). For the purpose of this contest, a week begins at 5:01 PM ET on Monday
and ends at 5:00 PM ET on the following Monday, except for the first entry period,
which begins at 12:01 AM ET on Monday June 9. Each weekly winner will be announced
every Friday, starting on June 20th.
ELIGIBILITY: Contest is open to legal residents of the 50 United
States and the District of Columbia, who are of legal age of majority in their jurisdiction
in which they reside (and at least 18 years of age) and who are parents or legal
guardians of a child who is 2-6 years of age at time of entry. Employees of Pure
Digital Technologies, PBS KIDS Sprout (“Sponsor”), Children’s Network LLC, its programming
partners, and their respective parents, members, subsidiaries, affiliates, and advertising
and promotion agencies, and members of their immediate family (spouse, parent, child,
sibling and their respective spouses, regardless of where they reside) and persons
living in the same household of such employees, whether or not related, are not
eligible to enter or win. Void where prohibited by law. Contest is subject to all
applicable federal, state and local laws.
HOW TO ENTER: During the Contest Period, to enter, visit www.SproutOnline.com
and follow the directions provided to fill out the entry form, upload a drawing
by your preschooler (ages 2-6) of what your preschooler loves to do with his/her
family, and submit. Drawing must be submitted in gif or jpeg format and cannot be
larger than 1 MB. All entries must be received by 5:00 p.m. ET on August 25, 2008.
Entries received from any person, email address or household in excess of the limitation
for any Entry Period will be void. All entries become the sole property of the Sponsor
and will not be returned.
Artwork and any other element of the drawing must be the original work of entrant’s
child or legal ward, previously unpublished, must not infringe upon the copyrights,
trademarks, rights of privacy, publicity or other intellectual property or other
rights of any person or entity and cannot have been submitted in connection with
any other contest. Notwithstanding the above, drawing may include Sprout characters.
Entry must be in keeping with the Sponsor’s image and may not be offensive or inappropriate,
as determined by the Sponsor in its sole discretion, nor can it defame or invade
publicity rights or privacy of any person, living or deceased, or otherwise infringe
upon any person’s personal or property rights or any other third party rights. Sponsor
reserves the right to disqualify any entry in which there are non-Sprout characters,
that is offensive or inappropriate, not in keeping with Sponsor’s image or that
is otherwise not in compliance with these Official Rules.
JUDGING: All eligible entries received by Sponsor will be judged
by a panel of qualified judges equally on the following criteria: creativity, appearance
and innovation (“Judging Criteria”), to select one (1) winner for each Entry Period.
In the event of a tie, an additional, “tie-breaking” judge will determine the winner
for the applicable Entry Period based on the Judging Criteria. Non-winning entries
from one Entry Period may roll over to subsequent Entry Periods. Sponsor reserves
the right to not select a winner for any Entry Period if, in its sole discretion,
it does not receive a sufficient number of eligible and qualified entries for such
Entry Period. Judges’ decisions are final and binding in all matters relating to
this Contest.
WINNER NOTIFICATION: Potential winners (who will be the eligible
individual submitting the entry and not the preschooler whose art is depicted) will
be notified by telephone, mail and/or email. Sponsor’s inability to contact a potential
winner within a reasonable time period, the return of a prize or prize notification
as undeliverable or noncompliance with these Official Rules by any potential winner
will result in disqualification and, at Sponsor’s discretion, the prize may be awarded
to the runner-up for the applicable Entry Period. Sponsor reserves the right to
notify winners in person and to record, photograph and videotape the visit and any
other activities in which winner may be involved at such time (collectively, “Notification
Footage”). Notification Footage will be owned by Sponsor who has the right to use,
edit, adapt, post, stream, copy and exploit such Notification Footage and all elements
embodied therein, including the name, likeness, performance and statements of the
winners embodied therein, in any and all media now known or hereafter created throughout
the world in perpetuity, for advertising, promotional, trade and other purposes
without further compensation, approval or notice.
PRIZES (11): A personal video camera (manufacturer and model to
be determined by Sponsor) and the conversion of the winning entry into an animated
piece to be exhibited on Sprout on a date to be determined by Sponsor between 11:30
AM ET and 12:00 PM ET [Note: The animation for the last winner will not be posted
during the Contest Period.]. Approximate Retail Value (“ARV”): $150 each. Exact
details of animation, including length, are at the sole discretion of Sponsor. Sponsor
does not guarantee that the animation will be posted. Prizes are awarded “as is”
with no warranty or guarantee, either express or implied by Sponsor. No substitution,
cash equivalent or transfer of a prize is permitted, except by Sponsor, who reserves
the right to substitute a prize (or portion thereof) with one of comparable or greater
value, at its sole discretion. Any and all federal, state and local taxes on prizes
as well as any other costs and expenses associated with prize acceptance and use
not specified herein as being provided are the sole responsibility of the winners.
All prize details are at Sponsor’s sole discretion.
Additionally, Sponsor may in its sole discretion identify honorable mention winners
within each Contest Period. These winners will receive a personal video camera (manufacturer
and model to be determined by Sponsor).
OWNERSHIP/USE: By submitting an entry, entrant agrees Sponsor shall
own the entry submitted (including all rights embodied therein) and that it and
its designees may exploit, edit, modify, and distribute the entry and all elements
of such entry, in any and all media (including on www.Sproutonline.com and for exhibition
as an animated piece on Sprout) now known or not currently known, throughout the
world in perpetuity without compensation, permission or notification to entrant
or any third party.
GENERAL: By participating, each entrant agrees: (a) to abide by
these Official Rules and decisions of Sponsor and judges, which shall be final and
binding in all respects relating to this Contest; (b) to release, discharge and
hold harmless Pure Digital Technologies, Sponsor, Children’s Network LLC, its programming
partners, and their respective parents, members, affiliates, subsidiaries, and advertising
and promotion agencies, and the respective officers, directors, shareholders, employees,
agents and representatives of the forgoing (collectively, “Released Parties”) from
any and all injuries, liability, losses and damages of any kind to persons, including
death, or property resulting, in whole or in part, directly or indirectly, from
entrant’s participation in the Contest, the acceptance, possession, use or misuse
of any awarded prize or Released Parties’ use of any of the rights granted herein
or any use of entry submitted; and (c) to the use of his/her name, his/her child’s
or legal ward’s name, city and state of residence, photograph/video, image and/or
likeness for programming, advertising, publicity and promotional purposes in any
and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity
by Sponsor and its designees, without compensation (unless prohibited by law) or
additional consents from entrant or any third party and without prior notice, approval
or inspection, and to execute specific consent to such use if asked to do so.
Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen,
misdirected, undelivered or garbled entries; or for lost, interrupted or unavailable
network, server, Internet Service Provider (ISP), website, or other connections,
availability or accessibility or miscommunications or failed computer, satellite,
telephone or cable transmissions, lines, or technical failure or jumbled, scrambled,
delayed, or misdirected transmissions or computer hardware or software malfunctions,
failures or difficulties, or other errors or difficulties of any kind whether human,
mechanical, electronic, computer, network, typographical, printing or otherwise
relating to or in connection with the Contest, including, without limitation, errors
or difficulties which may occur in connection with the administration of the Contest,
the processing or judging of entries, the announcement of the prizes or in any Contest-related
materials. Released Parties are also not responsible for any incorrect or inaccurate
information, whether caused by site users, tampering, hacking, or by any equipment
or programming associated with or utilized in the Contest. Released Parties are
not responsible for injury or damage to participants' or to any other person's computer
related to or resulting from participating in this Contest or downloading materials
from or use of the web site. Persons who tamper with or abuse any aspect of the
Contest or website or who are in violation of these Official Rules or who attempt
to undermine the legitimate operation of the Contest by cheating, deception or other
unfair playing practices, or intend to annoy, abuse, threaten or harass any other
entrant or Sponsor’s representatives, as solely determined by Sponsor, will be disqualified
and all associated entries will be void. ANY ATTEMPT TO DELIBERATELY UNDERMINE THE
LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS
AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND
OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST
EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Should any portion of the Contest
be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized
human intervention or other causes which, in the sole opinion of the Sponsor, corrupt
or impair the administration, security, fairness or proper play, or submission of
entries, Sponsor reserves the right at its sole discretion to suspend, modify or
terminate the Contest (or portion thereof) and, if terminated, at its discretion,
award the prize for the applicable Entry Period(s) from all eligible, non-suspect
entries received for such Entry Period(s) prior to action taken using judging procedure
specified above.
